1. Who is responsible for the processing of your personal data?
Patek Philippe, as data controller, is responsible for collecting, using, and otherwise processing some of your personal data (the "Processing"). The purpose of this Privacy Notice is to let you know which personal data Patek Philippe collects about you, the reasons why Patek Philippe uses such personal data, how long Patek Philippe keeps them, what your rights are and how you can exercise them.

3. Which personal data are processed?
"Personal Data" includes any information relating to an identified (e.g., surname, first name) or identifiable (e.g., alias, passport number, nationality, address) natural person, namely the Data Subject.
Patek Philippe processes Personal Data to the extent necessary in the context of its activities, in particular:
- identification and contact related information (e.g., name, first name(s), gender, date of birth, phone number(s), physical and/or email address);
- financial data (e.g. bank account details and billing information);
- professional information (e.g., field);
- technical information (e.g., IP addresses, time zone, localization); and
- other data similar to the categories mentioned.
In addition, Patek Philippe may collect Personal Data that the Data Subjects communicate to Patek Philippe (e.g. during purchase process, a meeting, an event, by telephone, email or any other means of communication).
4. How is your Personal Data collected?
Patek Philippe receives and collects Personal Data:
- directly from the Data Subjects, in particular when filling in request or contact forms, purchasing our products, attending events or personal meeting; or
- indirectly through other sources, in particular through our distributors, retailers’ network or after sale service platforms.
5. For what purposes does Patek Philippe process Personal Data?
Patek Philippe generally processes and collects your Personal Data, including without limitation for the purposes of (collectively the "Purposes"):
- to fulfill its contractual obligations;
- to its legal and regulatory obligations;
- to pursue its legitimate interests;
- on the basis of the Data Subject's consent.
i. To fulfill its contractual obligations
Patek Philippe processes Personal Data in the course of the performance and management of the contractual relationship between Patek Philippe and Data Subjects. Patek Philippe may thus process Personal Data, in particular:
- to create and manage customer accounts;
- to manage and follow-up purchasing process of our products, including the management of our products warranty;
- to manage and follow-up after-sale services;
- to manage requests of archive extracts and of theft registration;
- to manage Data Subjects’ Personal Data in the context of events or exhibitions;
- to manage Data Subjects’ Personal Data in relation to Patek Philippe’s Magazine;
- for any other Purposes related to the execution and management of its contractual relationship with Data Subjects.
ii. To its legal and regulatory obligations
Patek Philippe is subject to various legal and regulatory obligations and has to comply with other legal process and law enforcement requirements, which may include laws outside the country the Data Subjects are located in, including, inter alia:
- to perform checks related to the fight against money laundering, terrorist financing or in relation to international sanctions;
- to provide information required by customs authorities;
- to respond to a request from a judicial or administrative authority;
- to fulfill its transaction reporting obligations.
iii. To pursue its legitimate interests
Patek Philippe may also process Personal Data in order to pursue its legitimate interests, and in particular for the following Purposes:
- to manage its website and IT infrastructure, and ensure IT security and operations;
- to ensure the maintenance and security of its premises and infrastructure;
- to establish, assert and/or defend actual or potential legal claims;
- to analyze and improve Patek Philippe's customer service quality and enhance customer experience;
- to manage the relationships with Patek Philippe retailers;
- to manage Patek Philippe’s archives;
- to analyze and anticipate consumption habits, behavior, interests and personal preferences of Data Subjects (profiling);
- to personalize the offer of products and services; and
- for marketing or market and opinion research purposes, unless a Data Subject has objected to the use of its data.
iv. On the basis of the Data Subject's consent
Patek Philippe may process Personal Data on the basis of the Data Subject's consent, when such processing cannot be based on the Purposes above, in particular for the following Purposes:
- to send invitation to events or exhibitions organized by Patek Philippe in Switzerland and abroad;
- to send its Magazine and/or its newsletters; and
- for any other Purpose for which the Data Subject has given his/her consent.
To the extent one or more of Patek Philippe's Processing of Personal Data presuppose(s) that the Data Subjects give their prior consent thereto, Patek Philippe will reach out to the Data Subjects concerned and ask for their consent in due time. In this case, the Data Subjects may withdraw their consent at any time. However, their consent remains valid for any Processing performed prior to the withdrawal of their consent.
The Data Subjects further understand that when they authorize a social network (such as Facebook, Instagram, etc.) to share Personal Data with Patek Philippe, Patek Philippe may receive any personal data publicly shared by them on the relevant social network, such as contact information (e.g. name, electronic address, gender, friends or contact lists) or information published on their profile (e.g. profile picture or preferences).
6. Is your Personal Data shared?
Within Patek Philippe, each affiliated company which requires Personal Data to fulfill its contractual and legal obligations shall have access to it, on a need-to-know basis only.
In addition, Patek Philippe may carry out operations with subcontractors or commercial partners in relation to its activities (the "Processors"). In this context, Patek Philippe may transfer Data Subjects' Personal Data to the following categories of recipients:
- Website hosts, as well as IT and data storage service providers;
- Payment service providers;
- Providers of communication services (e.g. in connection with the management of Patek Philippe's Magazine and newsletters, as well as the social networks used by Patek Philippe), events organizers or other services in connection with Patek Philippe's customer management; and
- Legal or administrative authorities, upon request and to the extent permitted by law.
7. Is your Personal Data transferred abroad?
Patek Philippe may disclose, transfer and/or store Personal Data outside Switzerland:
- in the context of the conclusion, performance and management of contracts directly or indirectly related to the business relationship (i.e. a contract concluded with you or with a third party, but in your interest);
- if it is required by law;
- where such a transfer is necessary to safeguard an overriding public interest;
- where such a transfer is necessary to enable Patek Philippe to establish, enforce or oppose a current or future claim, or to enable Patek Philippe to handle an investigation by a public authority, in
- Switzerland or abroad; and
- where you have given your consent.
If such a transfer of Personal Data is made to a country that does not offer an adequate level of protection of Personal Data from a Swiss perspective, Patek Philippe shall ensure, if required by the applicable regulations, that it obtains your consent or that it puts in place adequate safeguards, in particular contractual agreements, which may take the form of standard contractual clauses laid down by the European Commission (including the so-called "Swiss finish").

8. How long is your Personal Data kept?
We keep your Personal Data for as long as necessary for us to fulfill the Purposes or until you withdraw your consent, or exercises your right to be forgotten, provided that we are not legally required or permitted to continue to hold such Personal Data (e.g., to establish, exercise and/or defend legal claims, investigations or similar proceedings).
You may obtain additional information about the retention period of your Personal Data, or the criteria used to determine that retention period, by contacting Patek Philippe at the address provided in Section 2 above.
9. How is your Personal Data protected?
Patek Philippe takes all appropriate technical and organizational measures against unauthorized or illegal Processing of your Personal Data and accidental loss and/or destruction and/or damage of your Personal Data.
Personal Data may be stored on Patek Philippe technology systems/paper files or those of Patek Philippe Processors.
10. What are the Data Subjects' rights in connection with data protection?
At all times and subject to the limitations provided for by the applicable regulations, each Data Subject has the following rights:
- the right to access his/her Personal Data and to obtain a copy of it;
- the right to withdraw at any time the consent given for the processing of his/her Personal Data;
- the right to have his/her Personal Data rectified if it is inaccurate or incomplete;
- the right to request the deletion of his/her Personal Data when it is no longer necessary for the Purposes for which it was collected or processed or when the Data Subject has withdrawn his/her consent (in cases where the processing of the Personal Data in question is based on the consent of the Data Subject);
- the right to object at any time to the processing of his/her Personal Data for marketing purposes, including profiling;
- the right to object on legitimate grounds to the processing of his/her Personal Data;
- the right to request a limit on the processing of his/her Personal Data;
- the right to receive his/her Personal Data he/she has provided, in a commonly used and machine-readable format; and
- the right to file a complaint with the competent supervisory authority concerning the processing of his/her Personal Data.
Even where a Data Subject objects to the processing of his/her Personal Data, Patek Philippe is entitled to continue the processing if it is:
- required by law;
- necessary for the performance of a contract to which the Data Subject is a party;
- necessary for the performance of a task carried out in the public interest, or
- necessary for Patek Philippe's overriding legitimate interests, including the establishment, exercise or defense of legal claims.
Patek Philippe will not use for direct marketing purposes the Personal Data of Data Subjects who object to such processing.
In addition, Patek Philippe draws the attention of the Data Subject to the fact that, in the absence of certain of his/her Personal Data (or if the Data Subject exercises his/her right to object to the processing of his/her Personal Data), Patek Philippe may not be able to provide the Data Subject with the service or product for which the processing of such Personal Data is required.
11. Updates to this Privacy Notice
This Privacy Notice was updated in 2024. Patek Philippe reserves the right to amend this Privacy Policy to reflect changing legal requirements or Patek Philippe processing practices.
